New U.S. Customs Policy on Import Shipment Descriptions

Starting 12 November 2024, a new U.S. Customs and Border Protection (CBP) policy will impact import shipments to the United States. Under this regulation, CBP will reject any import shipment data at the point of origin that contains vague, imprecise, or incomplete descriptions. 

This initiative, outlined in CBP’s Cargo System Messaging Service (CSMS #60144714), aims to improve the clarity and accuracy of import documentation.

What You Need to Know

To avoid rejection, it’s important that all shipment descriptions are clear, detailed, and specific. CBP requires descriptions to provide an accurate account of what the goods are made of and their intended use. 

Non-compliant entries will trigger a “vague merchandise description” cargo message through CBP’s Automated Commercial Environment (ACE) system, notifying the entry filer and any involved brokers to correct issues for future shipments. 

Here’s what CBP considers an acceptable description:

  • Clear Descriptions: Avoid generic terms and instead use specific descriptions that convey the items' material and purpose. For example:some text
    • “Children’s toys made of plastic” rather than simply “toys.”
    • “Women’s dresses made of 60% cotton, 40% polyester” rather than just “clothing.”
  • Harmonised Code Classification: Always assign the correct Harmonised Code for each product.
  • Electronic Documentation: Submit customs documents electronically through systems like FedEx Electronic Trade Documents (ETD) to streamline communication with customs.
